Terms and Conditions for Using Zadkom Mobile App

 

These terms and conditions govern your use of the food delivery mobile application ("App") developed and owned by Abu Yousuf Trading  ("Company"). By accessing or using the App, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, do not use the App.

 

Use of the App

The App is designed to allow you to browse menus and place orders for food and beverages offered by restaurants listed on the App. The App provides a platform for the delivery of food and beverages to you from third-party restaurants.

  • You may use the App only for lawful purposes and in accordance with these terms and conditions.
  • You must be at least 18 years old to use the App. By using the App, you confirm that you are at least 18 years old.
  • You must provide accurate and complete information when using the App, including your name, phone number, address, and payment information.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • You may use the App only for personal and non-commercial purposes.
  • You may not use the App to order food or beverages for delivery to a location other than you own or that you are not authorized to use.
  • You may not use the App to harass, abuse, or harm others, or to engage in any unlawful activity.
  • You may not use the App to upload or transmit any viruses, malware, or other harmful code.
  • You may not use the App to interfere with or disrupt the operation of the App or any servers or networks connected to the App.
  • You may not use the App to collect or store any personal information of other users of the App.
  • You may not use the App to impersonate any person or entity, or to falsely state or otherwise misrepresent your affiliation with any person or entity.
  • You may not use the App to advertise or promote any products or services without the Company's prior written consent.
  • You agree to comply with all applicable laws and regulations when using the App.
  • You acknowledge and agree that the Company may monitor your use of the App for compliance with these terms and conditions.
  • You acknowledge and agree that the Company may terminate or suspend your access to the App at any time, without notice or liability, for any reason, including if the Company believes that you have violated these terms and conditions.
  • You acknowledge and agree that the Company may modify or discontinue the App at any time, without notice or liability.
  • You acknowledge and agree that the App may include links to third-party websites or resources. The Company is not responsible for the availability or content of these third-party websites or resources.
  • You acknowledge and agree that the App may include advertisements from third-party advertisers. The Company is not responsible for the content of these advertisements or for any transactions you may enter into with third-party advertisers.
  • You acknowledge and agree that the App may include user-generated content, such as ratings and reviews of restaurants. The Company is not responsible for the accuracy, completeness, or reliability of this user-generated content.
  • You acknowledge and agree that the App may collect certain information about your use of the App, including your location, device type, and usage statistics. The Company may use this information to improve the App and for other purposes as described in the Company's privacy policy.
  • You acknowledge and agree that the Company may send you promotional messages or offers via email, SMS or text message, or push notification.
  • You acknowledge and agree that these terms and conditions may be updated or modified by the Company from time to time, and that your continued use of the App after any such updates or modifications will constitute your acceptance of the updated or modified terms and conditions.

Delivery

The Company will use reasonable efforts to deliver your order to you within the estimated delivery time provided on the App. However, delivery times are not guaranteed and may be affected by factors outside of the Company's control.

  • You are responsible for providing accurate delivery instructions and ensuring that someone is available to receive the delivery.
  • The estimated delivery time provided on the App is an estimate only and may be affected by factors outside of the Company's control, such as traffic, weather, and restaurant preparation time.
  • The Company does not guarantee delivery within the estimated delivery time.
  • If the delivery is delayed for any reason, the Company will use reasonable efforts to notify you of the delay.
  • If you are not available to receive the delivery at the delivery location, the delivery driver may attempt to contact you by phone or text message.
  • If you do not respond to the delivery driver's attempts to contact you or if you are not available to receive the delivery, the delivery driver may leave the food and beverages at the delivery location at your own risk.
  • You acknowledge and agree that the delivery driver may use GPS or other location-based technology to locate your delivery location.
  • If the delivery driver is unable to locate your delivery location for any reason, the Company may cancel your order and refund any fees and charges you paid for the order.
  • If the food or beverages delivered to you are not as described on the App, you may contact the restaurant directly or contact the Company's customer support for assistance.
  • The delivery driver may refuse to deliver food or beverages to any location that the delivery driver deems unsafe or inaccessible.
  • The delivery driver may refuse to deliver food or beverages to any person who appears to be under the influence of drugs or alcohol.
  • The delivery driver may refuse to deliver food or beverages to any person who appears to be under the age of 18.
  • The delivery driver may request that you provide a signature or other proof of delivery.
  • If the food or beverages delivered to you are incorrect, damaged, or missing, you may contact the restaurant directly or contact the Company's customer support for assistance.
  • The Company may use third-party delivery services to deliver food and beverages to you.
  • The Company is not responsible for the acts or omissions of any third-party delivery services.
  • You acknowledge and agree that the delivery driver may take photographs of the delivery location and the food or beverages delivered to you as proof of delivery.
  • You acknowledge and agree that the Company may use your feedback and ratings of the delivery driver to improve the quality of the delivery service.

Ordering and Payment

  • You may place orders for food and beverages through the App.
  • The Company may charge you fees for using the App, including delivery fees and service fees. All fees will be displayed to you before you place an order.
  • Payment for your order will be processed through the App using the payment information you provide.
  • You are responsible for paying all fees and charges associated with your use of the App, including any taxes.
  • You are responsible for reviewing the menu items and prices listed on the App before placing an order.
  • You may only place orders for food and beverages that are available at the restaurant at the time you place the order.
  • The prices listed on the App may not include taxes or other fees, which will be added to your order at checkout.
  • The Company reserves the right to limit the quantity of items you may order through the App.
  • The Company reserves the right to cancel any order for any reason, including if the restaurant is unable to fulfill the order or if the order violates these terms and conditions.
  • If you have any food allergies or dietary restrictions, you are responsible for reviewing the menu items and ingredients listed on the App to ensure that the food and beverages you order are safe for you to consume.
  • The Company does not guarantee that the food or beverages delivered to you will be free from allergens or other harmful substances.
  • You may not resell or attempt to resell any food or beverages ordered through the App.
  • Payment for your order will be processed through the App using the payment information you provide.
  • If you believe that your payment information has been compromised or used without your authorization, you should contact your bank or credit card company immediately.
  • You may be required to provide additional information to verify your identity or payment information before placing an order.
  • The Company may use fraud prevention and detection measures to prevent unauthorized use of the App and to protect against fraudulent orders.
  • If you dispute a charge for an order, you should contact the restaurant directly or contact the Company's customer support for assistance.
  • The Company may offer promotions or discounts from time to time. The terms and conditions of any such promotions or discounts will be displayed on the App.
  • The Company may offer a loyalty program or rewards program for frequent users of the App. The terms and conditions of any such programs will be displayed on the App.
  • The Company may change its fees and charges from time to time. Any changes to fees and charges will be displayed on the App.
  • The Company may offer the option to tip the delivery driver through the App. Tipping is optional, and the amount of the tip is at your discretion.

Cancellation and Refunds

  • You may cancel your order at any time before the restaurant confirms the order. Once the restaurant confirms the order, you may not cancel the order.
  • If the restaurant is unable to fulfill your order for any reason, the Company will refund any fees and charges you paid for the order.
  • If you are dissatisfied with your order for any reason, you may contact the restaurant directly or contact the Company's customer support for assistance.
  • The Company reserves the right to cancel any order for any reason, including if the restaurant is unable to fulfill the order or if the order violates these terms and conditions.
  • If the restaurant cancels your order for any reason, the Company will refund any fees and charges you paid for the order.
  • The Company may issue refunds in the event of an order cancellation or if the food or beverages delivered to you are incorrect, damaged, or missing.
  • Refunds will be issued to the payment method you used to place the order.
  • Refunds may take several business days to appear on your account.
  • The Company reserves the right to refuse refunds for any reason, including if the Company believes that you have violated these terms and conditions.
  • The Company reserves the right to offer refunds in the form of credits to your wallet for future orders.
  • The Company may offer promotions or discounts from time to time that are subject to certain restrictions and limitations.
  • The Company reserves the right to modify or discontinue any promotions or discounts at any time, without notice or liability.
  • The Company may offer a loyalty program or rewards program for frequent users of the App. The terms and conditions of any such programs will be displayed on the App.
  • You acknowledge and agree that the restaurant is solely responsible for the quality and safety of the food and beverages it prepares and delivers.
  • The Company is not responsible for the quality or safety of the food and beverages delivered to you.
  • The Company may investigate any complaints or disputes regarding orders, cancellations, or refunds.
  • You acknowledge and agree that the Company's decision regarding any complaints or disputes is final and binding.
  • The Company reserves the right to take legal action to recover any fees or charges owed to the Company.
  • The Company may share your personal information with third-party payment processors and other service providers as necessary to process refunds and cancellations.
  • These terms and conditions may be updated or modified by the Company from time to time, and that your continued use of the App after any such updates or modifications will constitute your acceptance of the updated or modified terms and conditions.

Intellectual Property

The App and all content and materials included in the App, including text, graphics, logos, images, and software, are owned or licensed by the Company and are protected by intellectual property laws.

  • You may not use the App or any content or materials included in the App for any commercial purpose without the Company's prior written consent.
  • You may not copy, modify, distribute, display, or transmit any content or materials included in the App without the Company's prior written consent.
  • The Company's trademarks, logos, and service marks included in the App are owned by the Company and may not be used without the Company's prior written consent.
  • You acknowledge and agree that the App and all content and materials included in the App are protected by intellectual property laws, including copyright laws.
  • The Company may use your feedback, suggestions, or ideas for improving the App or for other purposes, without any obligation to compensate you for such feedback, suggestions, or ideas.
  • You may report any intellectual property infringement or violation by contacting the Company's designated agent for receiving notices of infringement.
  • The Company may investigate any reported intellectual property infringement or violation and may take appropriate action, including removing or disabling access to the infringing content or materials.
  • The Company may terminate the accounts of users who repeatedly infringe or violate intellectual property rights.
  • The Company may provide information to law enforcement agencies or other third parties as necessary to investigate and resolve any intellectual property infringement or violation.
  • The Company may use third-party content or materials in the App, including photographs and descriptions of menu items. Such content or materials are used under license and are the property of their respective owners.
  • The Company may display user-generated content, such as ratings and reviews of restaurants, on the App. You retain ownership of any user-generated content you submit, but by submitting such content, you grant the Company a non-exclusive, perpetual, royalty-free, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
  • You agree to indemnify and hold the Company and its affiliates, officers, directors, employees, and agents harmless from any claims, damages, liabilities, costs, or expenses arising from your violation of any intellectual property rights.
  • The Company may provide links to third-party websites or resources for your convenience. The Company does not endorse or assume any responsibility for any third-party websites or resources.
  • The Company may assign or transfer its rights and obligations under these terms and conditions to any third party without your consent.
  • These terms and conditions constitute the entire agreement between you and the Company with respect to your use of the App and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and the Company.
  • These terms and conditions will be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated.
  • Any dispute arising out of or relating to these terms and conditions or your use of the App will be resolved through binding arbitration in accordance with the rules of the Oman Goverment.
  • You may not assign or transfer your rights and obligations under these terms and conditions without the Company's prior written consent.
  • If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • The headings used in these terms and conditions are for convenience only and do not affect the interpretation of these terms and conditions.
